Important notice: These Terms and Conditions form a legally binding agreement between you and Gayle McVea. Please read them carefully before purchasing. By completing your purchase you confirm that you have read, understood, and agreed to these terms in full. If you have any questions before purchasing, please contact [email protected].
1. Parties to this Agreement
This agreement is between:
Gayle McVea, trading as gaylemcvea.com, a sole trader operating under the laws of Northern Ireland ("the Provider", "I", "me", "my").
And the individual purchasing access to the programme ("the Participant", "you", "your").
By completing your purchase you confirm that you are at least 18 years of age and are entering into this agreement on your own behalf.
2. The Programme
Unmuted is a 4-week live cohort programme consisting of:
– Four recorded module sessions, made available each week for participants to watch in their own time
– Four live weekly embedding sessions delivered via Zoom, where participants apply the week's learning with Gayle and the group
– Weekly practice tasks to apply between sessions
– Access to a group learning platform and community, for the duration of the cohort
2.1 The recorded module sessions are available during the programme duration only and can be revisited whilst the cohort is open. Access to the recordings will be removed after this time.
2.2 Live embedding sessions are delivered via Zoom. You are responsible for ensuring you have a suitable device and internet connection to participate. Dates and times for each live session will be confirmed on enrolment.
2.3 Live embedding sessions may be recorded. Where recordings are made, they will be made available to enrolled participants only and will not be shared publicly. Participants who have concerns about being recorded should contact [email protected] before the session. Participants may turn their camera off at any time.
2.4 The programme is delivered in English.
2.5 Unmuted is a personal development programme. It does not constitute therapy, counselling, medical advice, legal advice, or financial advice. If you are experiencing mental health difficulties, please seek appropriate professional support.
2.6 I reserve the right to make reasonable adjustments to the programme content, format, or schedule where necessary. I will communicate any significant changes to enrolled participants as soon as possible.
3. Booking and Payment
3.1 The price of the programme is as stated on the booking page at the time of your purchase. All prices are in GBP (pounds sterling) and are not subject to VAT. Gayle McVea is not VAT registered.
3.2 Payment is due in full at the time of booking. Your place on the programme is not confirmed until payment has been received and processed.
3.3 Payment Plan Where a payment plan option is offered at the time of booking, the following terms apply:
3.3.1 By selecting a payment plan, you agree to pay the full programme fee across two instalments, as set out at the point of purchase. The first instalment is due at the time of booking and secures your place on the programme. The second instalment will be collected automatically on the date specified at checkout.
3.3.2 It is your responsibility to ensure sufficient funds are available for each scheduled payment. If a payment fails, you will be notified and given 5 calendar days to resolve the issue. If the outstanding payment is not received within this period, I reserve the right to suspend or remove your access to the programme without refund of any amounts already paid.
3.3.3 Selecting a payment plan does not alter your cancellation rights under Section 4. Your 14-day cooling off period begins from the date of your first payment.
3.3.4 The total cost of the programme is the same whether you pay in full or by payment plan. No additional fees apply for choosing a payment plan.
3.4 All payments are processed securely through our payment provider. Gayle McVea does not store your card details.
3.5 Cohort places are limited. Completing your payment secures your place. Places are allocated on a first-come, first-served basis and cannot be held without payment.
3.6 If the cohort you have enrolled in is cancelled or significantly changed before it begins, you will be offered a full refund or a transfer to the next available cohort.
4. Your Right to Cancel (Cooling Off Period)
Under the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013, you have the right to cancel this contract within 14 days of purchase without giving any reason.
4.1 The cancellation period expires 14 days after the date on which your contract is entered into (i.e. the date of purchase).
4.2 To exercise your right to cancel, you must inform me of your decision by a clear written statement sent to [email protected] before the cancellation period expires. You may use the model cancellation form at the end of these terms, but you are not required to do so.
4.3 If you cancel within the 14-day cooling off period and the programme has not yet begun, you will receive a full refund within 14 days of your cancellation notice, using the same payment method as your original payment.
4.4 If you have requested that the programme begin within the 14-day cancellation period (for example, where you enrol shortly before the cohort starts and sessions have already begun), you acknowledge that you may be charged for the proportion of the programme already delivered. The charge will be calculated on a pro-rata basis (i.e. the number of weeks completed divided by 4, multiplied by the total programme fee).
4.5 Once the 14-day cooling off period has expired, the provisions in Section 5 apply.
5. Cancellation After the Cooling Off Period
5.1 After the 14-day cooling off period has expired, the programme fee is non-refundable. This applies regardless of whether you attend all sessions.
5.2 If exceptional personal circumstances arise after the cooling off period, please contact [email protected] to discuss your situation. While refunds cannot be guaranteed outside the cooling off period, requests will be considered on a case-by-case basis at my sole discretion.
6. Attendance and Participation
6.1 Live embedding sessions are an important part of the programme. While attendance is strongly encouraged, it is your responsibility to manage your diary and attend where possible.
6.2 Where live sessions are recorded and made available to enrolled participants, access to the recording does not replace the value of live participation. Recordings are provided as a supplementary resource only.
6.3 If you are unable to attend a live session, please notify in advance where possible at [email protected]. No refund or credit will be given for missed sessions.
6.4 The recorded module sessions are available from the start of each week. It is your responsibility to work through them at your own pace.
7. Your Responsibilities
To get the most from this programme and to support a positive learning environment for all participants, you agree to:
– Engage respectfully and constructively with Gayle and other participants at all times
– Maintain the confidentiality of what other participants share within the group setting
– Not record, screenshot, or share any live session content, other participants' contributions, or course materials without prior written consent
– Ensure you have a suitable device and internet connection for live Zoom sessions
– Approach the programme with honesty and a willingness to reflect and try things differently
I reserve the right to remove a participant from the programme without refund if their behaviour is repeatedly disrespectful, abusive, or disruptive to the group learning environment.
8. Confidentiality and Group Privacy
8.1 What is shared within the group learning environment is confidential. You agree not to share, repeat, or disclose the personal experiences, contributions, or identifiable information of other participants outside the programme.
8.2 I will not share your personal information or contributions with third parties without your consent, except where required by law.
8.3 I may use anonymised, non-identifiable feedback or case study information for professional development or marketing purposes. I will never share information that could identify you without your explicit written consent.
8.4 Where testimonials are gathered at the end of the programme, your permission will be sought explicitly before any testimonial is used for marketing purposes.
9. Intellectual Property
9.1 All course content, frameworks, tools, recordings, slides, and materials provided as part of this programme are the intellectual property of Gayle McVea.
9.2 By enrolling, you are granted a personal, non-transferable licence to access and use these materials for your own personal development only. You may not reproduce, share, distribute, teach from, or commercialise any part of the programme content without my prior written permission.
9.3 Unauthorised sharing or reproduction of course materials, including recordings, is a breach of these terms and may give rise to legal action.
10. Results and Outcomes
10.1 Coaching and personal development programmes work best when participants engage fully and consistently. Results depend significantly on your own commitment, effort, and willingness to apply what you learn. I cannot guarantee specific outcomes.
10.2 Testimonials and results shared on the booking page are illustrative of what participants have experienced and are not a guarantee that you will achieve the same outcomes.
10.3 This programme is for personal development purposes and does not constitute professional advice of any kind. You are responsible for any decisions you make as a result of your participation.
11. Limitation of Liability
11.1 To the fullest extent permitted by law, my liability to you in connection with this programme shall not exceed the total fees paid by you.
11.2 I shall not be liable for any indirect, consequential, or special loss or damage arising out of or in connection with your participation in this programme, including but not limited to loss of earnings, loss of business, or loss of opportunity.
11.3 I am not responsible for any technical difficulties you experience with Zoom or any other third-party platform used to deliver the programme.
11.4 Nothing in these terms limits or excludes my liability for death or personal injury caused by negligence, for fraud or fraudulent misrepresentation, or for any other liability that cannot be lawfully excluded under the Consumer Rights Act 2015.
12. Data Protection and Privacy
12.1 I take your privacy seriously. Your personal data will be processed in accordance with my Privacy Policy, available at gaylemcvea.com.
12.2 By purchasing this programme, you consent to me holding and using your contact details for the purpose of delivering the programme and maintaining records of your enrolment.
12.3 I will not sell or share your personal data with third parties for marketing purposes without your explicit consent.
12.4 You have the right to access, correct, or request deletion of your personal data at any time by contacting [email protected].
13. Governing Law and Disputes
13.1 These terms and conditions are governed by the laws of Northern Ireland. The courts of Northern Ireland shall have exclusive jurisdiction to settle any disputes arising from them.
13.2 If a dispute arises, I encourage you to contact me in the first instance at [email protected] so that we can try to resolve the matter informally and promptly.
13.3 Your statutory rights as a consumer are not affected by these terms. For more information about your rights you can visit the Citizens Advice website or contact the relevant consumer protection authority in your region.
14. Changes to These Terms
I reserve the right to update these terms and conditions from time to time. Any changes will be published on the booking page with an updated date shown at the top of this document. Changes will not affect the terms agreed with participants who have already enrolled in a cohort.
15. Entire Agreement
These terms and conditions, together with the programme description on the booking page and any written confirmation of your enrolment, constitute the entire agreement between us in relation to this programme. They supersede any previous discussions, representations, or agreements.
Appendix A: Model Cancellation Form
You do not have to use this form. You can cancel by sending any clear written statement to [email protected] within 14 days of purchase.
